Many people with a health condition assume they cannot claim, but the eggshell skull rule says otherwise. In other words, a defendant must take the victim as they find them. So, an existing weakness does not shrink your claim. Smith v Leech Brain & Co Ltd [1962] 2 QB 405 shows how this works in practice. At Dawn Solicitors, we also help claimants use this rule to protect their compensation.
First, the eggshell skull rule means a wrongdoer takes the victim as they find them. So, a defendant cannot argue that the claimant was unusually fragile. For example, courts once pictured a person with an unusually thin skull. If negligence causes injury, the defendant therefore pays for the full harm. Indeed, judges expressed this idea as early as Dulieu v White [1901]. Still, the rule matters most to people who live with a health condition today.
The facts of this case are simple but sad. One day, molten metal splashed at the galvanising factory where Mr Smith worked and burned his lip. However, his lip already carried pre-malignant cell changes that no one knew about. As a result, the burn triggered cancer, and he died about three years later. His widow then sued his employer.
First, Lord Parker CJ held that a burn was a foreseeable injury. So, the employer had to accept the unusually severe result. Also, the court applied the foreseeability test from The Wagon Mound (No 1) [1961]. Under that test, though, only the type of harm must be foreseeable, not its extent. Because of this, the pre-existing condition did not break the chain of causation. In the end, the widow succeeded.
Today, the rule helps claimants with conditions such as osteoporosis, heart disease or anxiety. So, an insurer cannot simply blame a pre-existing condition for the harm. You must still prove negligence and causation, though. Likewise, courts may reduce damages where the condition would have worsened anyway. For that reason, medical evidence matters a great deal. Also, honest disclosure of your history protects your credibility.
First, Dawn Solicitors listens to your story with care. Next, we gather medical records that show how your condition and the accident interact. We also instruct independent experts to separate old problems from new harm. Then, we challenge insurers who blame your history. As a result, you can seek fair compensation for the full impact of your injury.
